John Sawbridge, M.P.

John Sawbridge (1732–1795) was of the radical Whigs who joined the Rev. John Horne in supporting John Wilkes during the 1760s, forming the Society of Gentlemen Supporters of the Bill of Rights, and then leaving that group to form the Constitutional Society instead, as discussed yesterday.

Sawbridge first tried to run for Parliament in 1763, but bowed out when a more prominent Kentish gentleman wanted the seat. Reportedly, Tories tried to keep him in the race in hopes he’d split the Whig vote—the first time he had to deal with the rough and tumble of genteel Georgian politics.

Five years later, Sawbridge entered Parliament as a member for the town of Hythe, succeeding Lord George Sackville (Germain). At first he appeared to be one of the Duke of Grafton’s men, but he started to push Wilkes’s cause. As a result, Lord Grafton dropped Sawbridge, but the city of London adopted him, making him a sheriff and an alderman.

Then came the split with Wilkes. In 1771 Sawbridge was up for the post of Lord Mayor of London, but Wilkes threw his weight behind the incumbent instead. That year, the ministry’s preferred candidate won the office—Wilkes and Sawbridge had split the Whig vote.

Wilkes became increasingly vituperative, saying that “in politics [Sawbridge], poor man,…[could] see no farther than his nose.” Sawbridge had a big nose, but the cross-eyed Wilkes was hardly the one to criticize someone else’s vision. When that didn’t work, Wilkes complained that Sawbridge was a “proud Colossus of pretended public virtue.”

In response, Sawbridge kept talking about the importance of remaining politically independent of parties and, more radically, serving the people by voting the way they wanted. Most politicians preferred the approach Edmund Burke argued for, voting the way that you knew was best for them.

In the spring of 1774 Sawbridge and Wilkes reconciled. Sawbridge bowed out of the race for Lord Mayor in favor of Wilkes, who promised support in the fall’s parliamentary election. Sawbridge lost his seat in Hythe but won one in London. The next year, he also succeeded Wilkes as Lord Mayor.

Both men opposed Lord North’s policy toward the American colonies, but they were part of a small minority in Parliament. Over the next few years, Sawbridge allied with the Marquess of Rockingham and the Earls of Shelburne and Chatham rather than the more radical opposition. As Charles James Fox rose to lead the Whigs in the House of Commons, Sawbridge deferred to him.

In 1780, Sawbridge supported the Roman Catholic Relief Act. That proved to be wildly unpopular; the Gordon Riots paralyzed the city. Sawbridge lost support among Londoners, apologized humbly for taking a position that they didn’t like, and still came in fifth in a race for four seats.

However, one of the four frontrunners, John Kirkman, died on the day the polls closed. There was a special by-election, and this time Sawbridge won with no contest.

Four years later, the new prime minister, William Pitt, spent £2,000 supporting his own candidate in London. His party called Sawbridge a “republican” and “an avowed enemy to the constitution, to monarchy.” It didn’t help that Sawbridge’s older sister was the celebrated republican historian (and now married widow) Catharine Macaulay Graham.

Sawbridge insisted he wanted only reform in the Commons and protection for “the Rights of the People.” He pulled out a win in 1784 by only nine votes. He promptly resumed pushing for parliamentary reforms, which still went nowhere.

In 1790, Sawbridge sought reelection mainly for old times’ sake, even asking for the privilege to die in political service to the city of London. Voters chose him overwhelmingly. But then he suffered a stroke, so while he remained an M.P. until his death he was at least partially paralyzed.

Though contemporaries and historians agree that John Sawbridge was an ambitious man, he also stuck to his principles, which were ahead of his time.

From William Fitzmaurice to the Marquess of Lansdowne

William Fitzmaurice was born in Dublin in 1737 and grew up in rural southern Ireland. His parents were from aristocratic families, though neither had titles. William’s father John was a grandson of the Earl of Kerry through a younger son, and his mother Anne was daughter of a knight and brother of the first Earl of Shelburne.

Both those titles—Earl of Kerry and Earl of Shelburne—were in the Irish peerage. The men holding them were entitled to seats in the Irish House of Lords but not the British House of Lords, which covered England, Wales, and Scotland. Even though people in Great Britain addressed Irish peers by their noble titles, they were technically not British lords. I get the sense that British lords could look down on them a bit, but British commoners were supposed to look up.

In 1743, the year William turned six, his father John Fitzmaurice won a seat in the Irish House of Commons, which he held for the next eight years. At that point, in 1751, the status of the family began to change.

First, William’s uncle the Earl of Shelburne died, leaving his extensive property to John Fitzmaurice on the condition that he adopt his wife’s family name, Petty. John Fitzmaurice accepted the name John Petty Fitzmaurice, in later generations hyphenated as Petty-Fitzmaurice to make the alphabetization easier to remember.

Thus, in 1751 William Fitzmaurice, now in his teens, became William Petty Fitzmaurice.

Later in 1751, the Crown granted John Petty Fitzmaurice two noble titles: Viscount Fitzmaurice and Baron Dunkerton. It was very common for a peer to have subsidiary titles under his main one, moving down the ladder of peerages (duke, marquess, earl, viscount, and baron). Those titles for John Petty Fitzmaurice came in the Irish peerage, and the new viscount became a member of the Irish House of Lords.

Furthermore, in the British aristocratic system, the eldest son and heir of a peer is by courtesy addressed by his father’s second-highest noble title. Thus, in late 1751 William Petty Fitzmaurice became Lord Dunkerton.

In 1753 the Crown gave Viscount Fitzmaurice a promotion within the Irish peerage by recreating his late brother-in-law’s title of Earl of Shelburne for him. He was thenceforth addressed as Lord Shelburne.

That meant that in 1753 young Lord Dunkerton gained the courtesy title of Lord Fitzmaurice. That’s how he was addressed when he went off to Oxford University two years later.

As I said before, the Earl of Shelburne wasn’t entitled to a seat in Great Britain’s House of Lords because he was an Irish peer. Likewise, Lord Fitzmaurice, despite being able to use that courtesy title, wasn’t a British peer. As such, they could stand for seats in the British House of Commons. And that’s what Lord Shelburne did in 1754, winning a seat he held until 1760.

In that year, the Crown gave the Earl of Shelburne a title within the British peerage: Baron of (Chipping) Wycombe. That moved him out of the British House of Commons into the British House of Lords. People continued to call him Lord Shelburne because, even though the British peerage was more powerful than the Irish peerage, an earldom was more prestigious than a barony.

As for Lord Fitzmaurice, after his years at college he joined the British army and served under Gen. James Wolfe in the 20th Regiment of Foot. He saw action at Rochefort, Minden, and Kloster-Kampen. Good service and noble background allowed Fitzmaurice to become a military aide-de-camp to King George III in 1760, with the rank of colonel. Within the army he was thus Col. Fitzmaurice. (This rank was controversial since more senior officers were passed over, but it stuck. Furthermore, even though the man stopped being active in the army, he was by protocol promoted to major general in 1765, lieutenant general in 1772, and general in 1783.)

Also in 1760, Lord Fitzmaurice stood for his father’s seat in the British House of Commons and won. The next year he was elected to the Irish House of Commons representing County Kerry. But before he could take those seats, the situation changed again.

In 1761 the Earl of Shelburne died. Lord Fitzmaurice became the Earl of Shelburne within the Irish peerage and Baron Wycombe within the British peerage. He was no longer eligible to serve in either country’s House of Commons. (His successor in Britain was Col. Isaac Barré, a political protégé and fellow veteran of Gen. Wolfe’s regiment.)

It was as the Earl of Shelburne that the former Lord Fitzmaurice, former Lord Dunkerton, former William Petty Fitzmaurice, born William Fitzmaurice, became a player in British-American politics. Prime Minister George Grenville appointed him First Lord of Trade in 1763, but Shelburne decided to ally with William Pitt and resigned a few months later. When the Marquess of Rockingham and Pitt (now Earl of Chatham) formed a government in 1766, Shelburne became Southern Secretary, but was pushed out after two years.

After 1775, Shelburne sided with Chatham, Rockingham, Barré, and others in opposing Lord North’s war policies. (Lord North was in the House of Commons, not the House of Lords, because his courtesy title came from being son and heir of the Earl of Guilford.) When news of the defeat at Yorktown arrived, Lord North’s ministry fell and was replaced with a government led by the Marquess of Rockingham. Shelburne was named one of two Secretaries of State—the first Home Secretary, in fact.

Then Rockingham died after only a few months, and the Earl of Shelburne became Prime Minister in July 1782. He and his envoys handled most of the negotiations with France, Spain, and the U.S. of A. to create the Treaties of Paris. However, before those documents were signed, Shelburne’s coalition fell because of internal wrangling. Rockingham’s other Secretary of State, Charles James Fox, made an alliance of convenience with Lord North to oust Shelburne in April 1783.

The next year, young William Pitt the Younger took over the Prime Minister’s office. Rather than bring his father’s old ally Shelburne back into government, he arranged for the man to gain a British peerage higher than his Irish one: Marquess of Lansdowne. That was the former William Fitzmaurice’s main title from 1784 until his death in 1805.

The marquess stayed out of politics, but he did do something significant in American culture: he commissioned Gilbert Stuart to create a full-length portrait of George Washington. Stuart delivered that picture in 1796. The artist also produced copies of what became known as the “Lansdowne portrait,” including one hung in the White House since 1800. The marquess’s descendants sold the original to the U.S. National Portrait Gallery in 2001 for $20 million.

The seed for this posting was my realization that mentions of Lord Shelburne and Lord Lansdowne in the late 1700s referred to the same man. I started to wonder whether his name and status had changed at other times in his life. I had no idea how complicated the answer would be.

Getting to Know the Prime Ministers

George Grenville was the prime minister of Great Britain in 1765, when he pushed Parliament to pass the Stamp Act.

The Duke of Portland was prime minister in 1783 when British diplomats signed the Treaty of Paris.

Between those two men, five others served as prime minister, one in two separate stints. Lord North held the job for longer than all the others put together, so he was the most important to the American Revolution. Even so, all those men led governments that made crucial decisions on Britain’s colonial policy.

It’s tempting to view Downing Street politics of that time through the model of today’s British government, but that would be a mistake. Changes in the British cabinet during the eighteenth century had more to do with personalities, the king’s preferences, and chance than with national party politics and majorities.

I’m therefore grateful to have found the Prime Ministers podcast. In each episode, the political journalist and former Conservative office-seeker Iain Dale interviews a historian about one person who served as Britain’s prime minister since Robert Walpole first defined the office. I’ve been picking out the episodes on the eighteenth century.

The podcast and Dale’s choice of interlocutors are based on his anthology of profiles The Prime Ministers: 55 Leaders, 55 Authors, 300 Years of History. It was published in the U.K. last year and is scheduled to come out in the U.S. of A. at the end of 2021.

One insight from those discussions was how experience in the House of Commons was usually important for a prime minister’s success, yet the system still favored candidates from the hereditary aristocracy. After Grenville the prime ministers included two dukes, a marquess, and two earls.

One of those earls, Chatham, had the best years of his career as William Pitt in the House of Commons. The other, Shelburne, never got to sit in Parliament as a young man and therefore, the podcast discussion suggests, he lacked the negotiating experience needed to win members over to his policies.

Lord North’s title was a courtesy; he wasn’t yet a peer but only the son and heir of the Earl of Guilford, so he was eligible for the Commons. That seat gave North lots of experience in party politics and legislation, leading to that long tenure as prime minister. In fact, less than two years after losing office because of Yorktown, North maneuvered himself back into being one of the real powers behind the Duke of Portland.

Another valuable lesson of these profiles is that events in America rarely played a role in changes at the top of the British government. Grenville lost favor with the royal family, depression led the Chatham ministry to crumble, and the Duke of Grafton left because of developments in Corsica. Only Lord North lost the post because of what happened on the far side of the Atlantic.

When Wartime Riots Paralyzed London

On 2 June 1780, as I described yesterday, a crowd of over 50,000 people surrounded Parliament while Lord George Gordon presented a petition demanding a return to strictures on Catholics.

The House of Commons dismissed that petition, and the crowd dispersed from that part of London. But that evening people attacked the embassy of Sardinia. They destroyed a chapel connected to the embassy of Bavaria. They attacked neighborhoods of prominent Catholics. Sir John Fielding’s Bow Street Runners and other authorities arrested some rioters and locked them in Newgate Prison.

The next day, 3 June, larger crowds rampaged through Moorfields, a neighborhood where a lot of Irish workers had settled. A mob attacked Newgate Prison, freed fellow rioters and other prisoners, and then basically destroyed the complex. Then people attacked other prisons, and other embassies. They attacked the home of Lord Mansfield, the Chief Justice, who had supported the more liberal law about Catholics.

Violence continued for days, spilling well beyond the original grievances. On 7 June, there was a concerted assault on the Bank of England, stopped only by an upper-class militia unit and regular troops. All in all, the property damage cost up to £180,000, which many historians say was far more than the city of Paris suffered during the whole French Revolution. (I’d like to see the comparable figures, but that’s what they say.)

On that 7 June, the British government clamped down on the rioters with force. It brought in regular troops, including the Horse Guards and Foot Guards, as well as militias from nearby counties—12,000 armed men in all. Soldiers killed nearly 300 people and arrested 450, pacifying the city after a week of chaos. The government put scores of men on trial and sentenced dozens to death for acts of violence and theft, though not all those sentences were carried out.

London’s upper and middle classes, scared by the violence, supported such harsh measures. The Crown fined the Lord Mayor for not reading the Riot Act to the crowds earlier. A former Lord Mayor, John Wilkes, led troops against the rioters, ruining his reputation as a champion of the people and thus his political career. Another radical Whig, the Earl of Shelburne, responded to the uprising by proposing a national police force, but nothing came of that.

As for Lord George Gordon, he was locked up in the Tower and tried for treason, but acquitted. Nevertheless, the disturbances were named after him: the Gordon Riots. He continued to get in trouble with the authorities, eventually locked up again for insulting Marie Antoinette of France and the British legal system. By then he had converted to Judaism—beard, circumcision, and all—and he became quite a curiosity while locked up in the rebuilt Newgate Prison.

The unrest had at least one effect on the American Revolution. Early in 1780 Spain and Britain had started secret negotiations which could have led to Spain pulling its support for the new U.S. of A. The riots convinced Spanish diplomats that Lord North’s government might soon fall, so they ended the talks.

The B.B.C. radio program In Our Time recently hosted a discussion about the Gordon Riots, available as a podcast. The London Historians offers an introduction to the unrest by Prof. Jerry White in P.D.F. form. The episode was also fodder for nineteenth-century British novelists: Maria Edgeworth with Harrington and Charles Dickens with Barnaby Rudge. But of course, unlike the Stamp Act riots in North America and the storming of the Bastille in Paris, the Gordon Riots didn’t lead to revolution.

“Such a prudent and proper Use of this Letter”

On 29 Feb 1768, as I described yesterday, the passengers on the Abigail finally made it to solid ground in Boston after a terrible fourteen-week voyage from London.

Among those passengers was a new Customs officer named Thomas Irving, who carried a letter of introduction to Gov. Francis Bernard. The economic historian John McCusker reports that letter was dated 23 Oct 1767 and marked as received on Sunday, 30 Jan 1768, which gives us a benchmark for other letters that may have traveled on the Abigail.

On Monday, 1 February, in the Representatives’ chamber:
The Speaker [Thomas Cushing] communicated a Letter from Dennys DeBerdt, Esq; which was read and communicated for Consideration to Mr. Speaker, Capt. [Edward] Sheaffe, and Brigadier [Timothy] Ruggles.
The Colonial Society of Massachusetts published a set of DeBerdt’s letters in 1911. One of those was dated 21 Oct 1767, shortly before the Abigail set sail, and addressed to Whig legislator Edward Sheaffe of Charlestown, appointed to the committee to reply. It’s possible that Cushing brought forward another letter that hasn’t survived, but this appears to be the most likely candidate.

In that letter DeBerdt pressed to be appointed as the official lobbyist for the whole Massachusetts provincial government, not just the House. He added, probably as a sign of his access, “I shall have a Conference with the Secretary of State in a few days…“

That likely reminded legislators of DeBerdt’s last letter to Cushing, dated 19 Sept 1767, in which he wrote about the Earl of Shelburne being sympathetic to the colonies and added:
He had also wrote to every Governour on the continent to behave with temper & moderation to the severl. Provinces over which they preside, & he had wrote to your Governour in particular to persue healing measures & was so condesending to offer shewing me Copy of his letter the next time I waited on Him
The Massachusetts Whigs had been so pleased with that assurance that London wanted their governor to act more moderate that they had the letter published in the 10 November Boston Gazette.

On Wednesday, 3 Feb 1768, the legislators were treated to a different message from London:
Mr. Secretary [Andrew Oliver, shown above], by Order of the Governor, came down and Read in the House a Letter from the Right Honorable the Earl of Shelburne to his Excellency [the governor], and then withdrew.
Bernard had just received a copy of Secretary of State Shelburne’s letter dated 17 September, forwarded from New York. (The signed original didn’t arrive until April, amazingly late.) This was the dispatch that DeBerdt had suggested would show Shelburne advising more “healing measures.”

Instead, that letter offered Bernard solid support for all the steps he had taken. Shelburne began, “I have the Pleasure to signify to you His Majesty’s Approbation of your Conduct, and to acquaint you that he is graciously pleased to approve of your having exerted the Power…” He went on to say:
I am to inform you, Sir, that it is His Majesty’s determined Resolution to extend to you His Countenance and Protection in every Constitutional Measure that shall be found necessary for the Support of His Government in the Massachusets Bay.
No doubt pleased, Bernard replied:
I shall make such a prudent and proper Use of this Letter, as I hope it will restore the Peace and Tranquility of this Province, for which Purpose considerable Steps have already been made by the House of Representatives.
The “prudent and proper Use of this Letter” that Bernard planned was to have Secretary Oliver read it to the House, pushing lawmakers to recognize the reality that he had the royal government behind him.

That didn’t work. Instead, the very next day the House decided to repudiate its earlier vote not to send a circular letter to the other colonial legislatures. Whatever “considerable Steps” toward “Peace and Tranquility” Bernard perceived on 2 February were gone two days later. The House decided to communicate with other colonial governments, even if that did breach protocol.

Furthermore, Massachusetts legislators focused on one phrase from Shelburne: “from your several Letters.” For the rest of the session, House leaders periodically asked Bernard for “a Copy of the Letter from the Right Honorable the Earl of Shelburn, lately read to the House by Order of his Excellency, and his own several Letters to which it refers.” The governor gave Cushing a copy of Shelburne’s letter but stonewalled on sharing his own, which is what the Whigs really wanted.

As discussed back here, Massachusetts politicians were convinced Bernard was writing bad things about them to London. All the more reason to form a united front with other colonial legislatures!

And all that time, nobody in Boston knew that the Earl of Shelburne’s opinions no longer mattered. There had been a shakeup in the British government. The Earl of Hillsborough had assumed responsibility for the North American colonies, and he was stricter than his predecessor.

Behind Massachusetts’s Circular Letter

The story of the Massachusetts Circular Letter of 1768 starts with the previous year’s session of the Massachusetts General Court.

That provincial legislature was supposed to reconvene after its spring session on 2 Sept 1767. But that summer Parliament enacted the Townshend Act, a new way of raising revenue in the American colonies.

Newspaper essayists protested the new law. Boston’s town meeting started talking about cutting imports. John Dickinson’s Letters from an American Farmer appeared. Gov. Francis Bernard delayed calling the legislature back into session as long as he could.

But finally, with a border dispute with New York to be resolved, the governor reconvened the General Court on 30 December. That was “sooner than I intended,” he told his superior in London; “rather earlier than usual,” he told the legislators.

Instead of taking up the border issue, the House proceeded to consider “the State of the Province” and its charter in relation to “divers Acts of Parliament”—meaning the Townshend Act. The House formed a committee to address those questions dominated by strong Whigs: speaker Thomas Cushing, clerk Samuel Adams, both James Otises, Joseph Hawley, John Hancock, Edward Sheaffe, Jerathmeel Bowers, and Samuel Dexter. Only then did the House turn to other matters.

According to Bernard, Cushing had told him before this legislative session that the House planned to protest the Townshend Act. In reply, the governor warned that Parliament would probably not be amenable, adding:
that if they should think proper to address his Majesty’s Secretary of State upon this occasion, it was my Official Business to take the charge of it & I should faithfully remitt it whatever the contents were. And if they put it into other hands, I should remonstrate against it as being irregular & unconstitutional for any addresses to pass from an Assembly (where the King has a representative presiding) to his Majesty either directly or indirectly, except thro’ the mediation of his Representative.
By “other hands,” the governor meant Dennis DeBerdt, the new agent, or lobbyist, for the Massachusetts House in London. Bernard had tried to stop the House from hiring DeBerdt because he thought that a single chamber of the legislature shouldn’t have its own lobbyist, independent of the Council and himself.

Naturally, the House committee responded by first drafting a letter to DeBerdt, which it presented to the whole chamber on 12 January. The principal authors of that document and the committee’s other productions appear to have been James Otis, Jr., and Samuel Adams, though it’s unclear how they collaborated.

The representatives went through two days of intermittent debate. Bernard understood that “many Offencive passages were struck out.” But eventually the House approved that text and instructed Speaker Cushing to sign it on their behalf.

On 15 January, that first letter finally done, the same committee proffered a similar missive to the Earl off Shelburne as Secretary of State for North America. Nobody knew that Shelburne had been dismissed from that post at the end of October.

Five days later, the committee rolled out its biggest gun yet: a letter to King George III himself. The House approved that “humble Petition to the KING” after “divers Amendments.” All this time, Gov. Bernard was asking Cushing to see the letters. The speaker put him off, saying the chamber had voted not to make any copies until he was to sign the documents.

On 21 January, the House took up yet another proposal from the committee: to send a circular letter on those issues to all the other North American legislatures. Circular letters were a standard bureaucratic tool; the London government sent them regularly to the royal governors. But legislatures were supposed to communicate upward to those governors and the Crown, not independently. And especially not to create a united front against one of Parliament’s laws.

“Destroying all party distinctions”

As stated in a passage I quoted a couple of days ago, soon after Charles Townshend died, his post as Chancellor of the Exchequer was offered to Lord North, who accepted it on 11 September. That quick succession made the British government of the time seem more stable than it was.

The leading minister in London was William Pitt, Earl of Chatham. Normally the prime minister was also First Lord of the Treasury, but Pitt had instead taken a peerage and the post of Lord Privy Seal. His ally, the Duke of Grafton (shown here), took the Treasury title.

Chatham promised King George III in 1766 that this government would be based on “measures not men,…destroying all party distinctions.” He would recruit other ministers based on their talents, not their alliances, and thus unite many factions.

That hadn’t worked out. By accepting that earldom Pitt, formerly “the Great Commoner,” had lost a lot of his popularity in London. Then he fell ill with gout and depression. Chatham turned over almost all legislation to the ministers he’d appointed, declining even to meet with them. The result was squabbling and lack of coordination among men with competing ambitions and loyalties.

That situation affected the American colonies. The minister with the most responsibility for administering those colonies was the Secretary of State for the Southern Department, the Earl of Shelburne. He, like Chatham, supported preserving American autonomy. But he couldn’t institute any of his policy choices.

Meanwhile, Townshend gained more power over fiscal policy than preceding Chancellors of the Exchequer, becoming a full member of the cabinet. After losing a fight in Parliament over a higher land tax (never popular with Britain’s big landowners), he turned to a new source of revenue: the American colonies. Townshend focused on import tariffs, thinking those were the sort of “external taxes” that the colonists would accept.

Townshend suddenly died when the Duke of Grafton was struggling to hold together the government for Chatham without Chatham’s help. Soon the First Lord brought in one faction of the Whig opposition, that grouped under the Duke of Bedford, shuffling appointments to make room. In February 1768, the ministry created a new post—Secretary of State for the Colonies—for the Earl of Hillsborough, who favored more control from London.

Britons in America followed all that news, of course, but it was even more confusing at a distance. They still clung to hope that Chatham was in charge, watching out for them.

Elizabeth Armistead, Wife of Charles James Fox

Last month Geri Walton, author of Marie Antoinette’s Confidante, profiled Elizabeth Armistead (1750-1841).

A courtesan and actress in London, Armistead was mistress to the second Viscount Bolingbroke; Gen. Richard Smith, head of the East India Company; the third Duke of Dorset; the twelfth Earl of Derby; and Lord George Cavendish.

And then came Charles James Fox, the Whig politician who was Foreign Secretary at the end of the American war. Walton wrote:
Fox and Elizabeth did not start out as lovers. They had a decade long platonic friendship before they became lovers. After their love affair began, one person asked Fox why he was suddenly absent so much from the gentleman’s club he attended called Brooks’s. He supposedly replied:
“You know I have pledged myself to the public to keep a strict eye on Lord Shelburne’s motions; and that is my sole motive for being so much in Berkeley-square; and that, you may tell my friends, in the sole reason they have not seen me at Brookes’s [sic].”
Fox had always been considered a rake, a drinker, and a gambler. Moreover, he was a notorious womanizer. . . . If Elizabeth planned to have a temporary fling with Fox, it soon turned long-lasting and exclusive. The exclusivity soon caused her financial problems and when she attempted to end her relationship with Fox, Fox would not allow it as he was too smitten.
“I have examined myself and know that I can better abandon friends, country, everything than live without Liz.”
Fox’s gay and frivolous lifestyle ended when he married Elizabeth secretly on 28 September 1795. . . . because of Elizabeth’s past, news of the marriage would cause a scandal and so Fox felt that he could not introduce her into society (supposedly she also insisted that he not do so).

It took seven years before he formally introduced Elizabeth as his wife.

James Townsend, Lord Mayor with a Secret?

James Townsend (1737-1787) was a London alderman from 1769 to his death, sheriff of London in 1769-70 and Lord Mayor in 1772-73.

He was also a Member of Parliament for two stints, in 1767-74 and 1782-87. Unlike his father, who allied with George Grenville, Townsend became part of Lord Shelburne’s wing of the Whigs.

That put him on the left of British politics. The History of Parliament Online says of Townsend:
He made himself conspicuous in Parliament as an advocate of [John] Wilkes’s cause, contributed to his election expenses, and was a foundation member of the Bill of Rights Society. In 1771 he refused to pay the land tax on the ground that Middlesex was not represented in Parliament.
That was, of course, an argument about taxation without representation within greater London itself.

In 1772 Townsend and John Horne Tooke broke with Wilkes while still remaining radical reformists. That year, Wilkes won more votes for Lord Mayor than anyone else, but the sheriff manipulated the voting process to put Townsend in office instead. That prompted riots against the new mayor, and he served only one term.

In October 2016 Notes and Queries discussed another aspect of Townsend’s life: one of his eight great-grandparents was African. In the part of eastern Africa that Europeans then called the Gold Coast, now Ghana, that woman reportedly had a child with a Dutch soldier.

That child, named Catherine, married James Phipps, a long-time employee of the Royal African Company of England. Toward the end of his life Phipps was the Captain-General of the company and Governor of Cape Coast Castle. In 1722 he lost those posts after being accused of embezzling and abusing power, and the following year he died. Phipps had wanted to bring his wife to Britain, even writing incentives for her to do so into his will, but she never left Africa. Instead, she became a major trader (and slaveowner) on the Gold Coast.

Back around 1715, the couple had sent two of their daughters, Bridget and Susanna, to Britain. Both girls, who had one African grandparent, were then around nine years old. Phipps’s family was surprised to receive “some issue” of him, but they duly sent those girls to a school in Battersea. Phipps’s wealth no doubt helped—there might have been something to those embezzlement charges.

In 1730 Bridget Phipps got married in the Fleet Prison, the venue probably chosen to evade parents and guardians. Her new husband was a London merchant and mining investor named Chauncy Townsend. They had many children, including James.

James Townsend’s legal papers in Britain reportedly contain no hint of his African great-grandmother. Nor does that ancestry appear to have come up in gossip about him as a politician. As Wolfram Latsch wrote in Notes and Queries and this blog post, “this fact was either unknown, or went unnoticed, or it was ignored.” His grandmother’s decision to stay away from Britain was probably a factor in how society perceived the Townsend family.

Latsch nonetheless identifies Townsend as “Britain’s first black MP” and the first black Lord Mayor of London. In one way he indeed was. But if no one knew about his ancestry, in another way he wasn’t.

The House of Lords Considers the Declaratory Act

The Rockingham government’s strategy to extricate itself from the unenforceable Stamp Act and yet maintain Parliament’s authority was to couple the repeal of that law with the Declaratory Act.

That act stated outright that Parliament’s laws were binding in British colonies. No other legislature in the empire could be more powerful than the Parliament in London. That would become part of the constitution of the British Empire.

In an undated letter to Lt. Gov. Cadwallader Colden of New York, Maj. Thomas James, who went to London after an anti-Stamp mob destroyed his house on 1 Nov 1765, described the Lords’ debate on the law this way:
the House of Lords in point of Question; whether the Mother Country has a Right to lay an Internal Tax upon the Americans? and whether the Colonies are not subject to the Decrees of King Lords and Commons.

Given by 125 to 5 That the Colonies are subject to the Laws of Great Britain; and that the Acts of the House of Commons are binding throughout all the Colonies of America

The 5 in favour of America were CambdenPauletTorringtonCornwallisShelburn — The first made a very Good Speech upon a Wrong Cause But the Lord Chancellor [the Earl of Northington] Cut Him to pieces; and observed; He wonderd how Lord Cambden could attempt to support so bad so dangerous and so unjust an Argument, with so serene a Countenance;

The Commons have resolved that the Colonies ought to be subject to the Laws and Decrees of Great Britain; they are softening all Resolves with a firmness, that they shall be permanent. The Repeal of the [Stamp] Act will be the last Resolve. I believe it will be softened—
Of the five peers who voted against the Declaratory Act, Baron Camden succeeded his nemesis Northington as Lord Chancellor later that year. Camden continued to advocate for American rights even more than his colleagues in the short-lived Chatham administration. His speech against the Declaratory Act indirectly led to the phrase “No Taxation without Representation.”

Charles Powlett, the Duke of Bolton, committed suicide in July. Not even Horace Walpole knew why. His brother succeeded him, switching from the opposition in the House of Commons to supporting the government until 1778, when he got sick of how the American War was going.

Viscount Torrington was a young man, only twenty-four. He married a daughter of the Earl of Cork in July, and they had several children. He voted for less strict policy toward America at a couple of other important moments but doesn’t appear to have been a vocal political leader.

The Earl of Shelburne became prime minister late in the American War and completed the 1783 Treaty of Paris to end it. Under his next and higher peerage, Marquess of Lansdowne, he was the recipient of Gilbert Stuart’s famous full-length portrait of George Washington.

And finally there’s Earl Cornwallis (shown above), in 1766 a lieutenant colonel in the army as well as a peer. We know what he had to do in the Revolutionary War. Afterwards, Cornwallis went on to a more successful career building the British Empire in India.

Hartley and Franklin, Reunited in Paris

I’ve been writing about the on-again, off-again correspondence of Benjamin Franklin and David Hartley, British scientist and Member of Parliament. Their relationship actually turned out to be a factor in the end of the war.

After London received news of the Battle of Yorktown, Lord North’s government fell. In March 1782 power shifted to the Marquess of Rockingham, longtime leader of the opposition, with a mandate to bring the American War to a close before it cost even more money. Rockingham filled the post of prime minister for all of four months before he died of the flu.

The Earl of Shelburne, one of Rockingham’s secretaries of state, took over. He was already steering negotiations with the U.S. of A.’s European diplomats through his envoy, the merchant Robert Oswald. By November 1782 Oswald worked out preliminary articles of peace with Franklin in France.

Meanwhile, Rockingham’s other secretary of state, Charles James Fox, refused to serve under Shelburne. He led other Rockingham Whigs, such as Edmund Burke, out of government. (That created openings for such rising politicians as William Pitt, who became Chancellor of the Exchequer at the age of twenty-three; they didn’t call him “the Younger” for nothing.)

David Hartley had opposed the American War all along, but he also disliked Shelburne and voted against the preliminary articles for peace. Hartley was a Fox ally, and he also maintained a personal friendship with Lord North, despite their political differences.

In April 1783 Fox and North, longtime opponents, made a surprising alliance to force Shelburne out of power. Shortly afterwards, George III appointed Hartley the new negotiator with the Americans. Fox and North both trusted Hartley, and they thought his friendly correspondence with Franklin would help to finish the negotiations on favorable terms.

Hartley walked into a very complex situation since France, Spain, and the U.S., though formally allied and bound to negotiate together, were all secretly angling for their own advantages and undercutting each other. Though there weren’t any more major campaigns on the North American continent, naval battles in the Caribbean and the siege of Gibraltar were still going on, tipping the balance of power and affecting different nations’ hunger for peace.

The Americans in Paris insisted on making very few changes to the terms they had reached with Oswald. If Hartley wasn’t going to sign over Canada, they weren’t about to concede anything else. France and Spain, meanwhile, thought the Shelburne ministry’s agreement to give the new American republic land all the way west to the Mississippi River was quite generous already.

In the end, the Treaty of Paris was basically what Oswald had negotiated eight months earlier. Hartley had voted against those terms, but his main contribution to the final treaty was the “Paris” part—he refused to leave the city for Versailles. On 3 Sept 1783, Hartley signed the final Treaty of Paris on behalf of Great Britain. Franklin, John Adams, and John Jay signed on behalf of the U.S.

Benjamin Vaughan, Franklin Fanboy

The Englishman who edited Benjamin Franklin’s essays for the press in 1779 was his admirer Benjamin Vaughan (1751-1835). Like Franklin, he had family in Boston.

Born in Jamaica, Vaughan was a grandson of the Massachusetts merchant captain Benjamin Hallowell, Sr. (The captain’s namesake son became one of the most hated of the royal Customs Commissioners in Boston.)

Vaughan’s immediate family were Unitarians, not fitting in with either New England Congregationalists or the established church in Britain. He attended dissenting grammar schools in Britain, and his faith limited the possibilities of a university degree.

Vaughan studied science under the Quaker scholar Joseph Priestley, then law, and finally medicine when he was trying to impress his future wife’s father that he could earn a steady living. But what really excited him was politics. He became a radical, which in Britain meant a republican. Vaughan stood somewhere between activists like John Horne and more establishment figures like the Earl of Shelburne. All that was going on while he collected Franklin’s older books and circulating manuscripts and prepared them for the press in 1779.

When Shelburne became prime minister in 1782, he asked Vaughan to go to Paris and use his relationship to Franklin to create a sort of back-door channel for news and reassurances. He wasn’t officially part of the British diplomatic delegation but seems to have contributed to the peace of 1783.

Vaughan served in Parliament from 1792 to 1794. Despite coming from the left, he opposed the idea of ending slavery in the British West Indies (his own family’s fortune was of course based on slave labor). When the old rivalry between Britain and France heated up again, this time with France as a militant republic, Vaughan came under suspicion of being a French sympathizer and fled the country.

Unfortunately, he arrived in France just as the “Terror” gave way to the “Thermidor” reaction, consuming one set of leaders after another. Vaughan was locked up on suspicion of being a British spy—I can’t tell exactly when and how his treatment fit with the swift changes in the French government at the time. But after a brief stretch in prison Vaughan made it out to Switzerland, then sailed for Boston in 1795.

Vaughan soon settled for life in Hallowell, Maine, where he had inherited land through his mother. His personal library was said to contain 10,000 books, one of the largest in the country. In American politics Vaughan became a firm Federalist, thus on the right. He finally started practicing medicine and promoted the use of Francis Jenner’s smallpox vaccine. He also built up his area of Maine with mills, wharfs, and stores.

There are papers related to Vaughan and his family at the Massachusetts Historical Society, the American Philosophical Society, the Clements Library, and elsewhere, given his correspondence with many early American statesmen. Vaughan’s house in Maine is now a historic site, though it’s not open to tours this summer.
